Article 1 – Definitions

• Withdrawal period: The period during which the consumer can exercise their right to withdraw from the contract.
• Consumer: A natural person acting outside the scope of their business activity.
• Right of withdrawal: The possibility to cancel a distance contract within the established legal timeframe.
• Seller: The legal entity offering goods/services at a distance – in this case: Elixyr Nootropics (Flowmerce LLC).
• Distance contract: A contract concluded without the physical presence of the parties through an organized sales system.
• Durable medium: A tool allowing information to be stored for future access without changes.

Article 2 – Identity of the Seller

Article 3 – Applicability

These conditions apply to every offer from Elixyr Nootropics and every contract concluded with a consumer. The conditions are made available before the contract is concluded in a clear and understandable manner.

Article 4 – The Offer

If an offer has a limited validity, it will be clearly stated. Product descriptions are accurate and photographs represent the actual products. Obvious errors are not binding for the seller.

Article 5 – Conclusion of Contract

The contract is formed at the moment the consumer confirms the offer. For electronic orders, the consumer will receive a confirmation via email.

Article 6 – Third-Country Shipments, VAT, and Customs

Goods are shipped directly from a country outside the US/EU (e.g., international fulfillment centers). The seller does not act as the importer.

• VAT and Customs: Any applicable import taxes and duties are payable upon import and are borne by the consumer.
• The customer is informed of potential import fees during the checkout process.
• Delivery times may be affected by customs procedures.

Article 7 – Right of Withdrawal

The consumer has the right to withdraw from the contract within 14 days of receiving the goods. The goods must be returned in their original packaging and in the same condition. Return costs are borne by the consumer.

Article 7a – Order Cancellation

Cancellation is only possible within 30 minutes of order placement. After this window, the order cannot be canceled without costs, though the right of withdrawal remains.

Article 8 – Exceptions to Withdrawal

The right of withdrawal does not apply to: custom-made goods, perishable goods, or goods unsealed for hygiene/health reasons (e.g., opened supplement bottles).

Article 9 – Prices

Prices include taxes only if charged by the seller. Import duties are paid separately by the consumer. Shipping costs are displayed before order confirmation.

Article 10 – Delivery

Orders are typically shipped within 14 days. Delivery is made to the address provided by the consumer. Fulfillment is handled directly by suppliers outside the local region.

Article 11 – Warranty

The seller guarantees that the goods correspond to the contract and description. Defects must be reported within 14 days of discovery.

Article 12 – Payment

Payments are due according to the details provided at purchase. Import fees are paid directly to the carrier.

Article 13 – Complaints

Complaints must be submitted within 14 days of discovering a defect. Processing will take place within 14 business days.

Article 14 – Governing Law

All contracts are exclusively governed by the laws of the State of California, United States.

Article 15 – Liability

Elixyr Nootropics is not liable for the incorrect use of products. Liability for indirect damages is excluded except in cases of intent or gross negligence. The seller is not responsible for customs delays.
